Victor Wembanyama drops case against man accused of using his likeness without permission, documents show

SAN ANTONIO – San Antonio Spurs phenom Victor Wembanyama dropped a lawsuit against a Texas man accused of using his name and likeness without permission, court records show.

In the federal lawsuit filed Oct. 15, Wembanyama attorneys accused James T. Glodich of filing a trademark application for sweatshirts and T-shirts branded “El Wemby.”

The lawsuit also stated that Glodich had refiled a trademark application for the “Wemby’s World” clothing brand for retail purposes.

The United States Patent and Trademark Office denied both applications because it “could falsely suggest an association with Victor Wembanyama, commonly referred to as ‘Wemby,’” the lawsuit said.

Wembanyama’s lawyers said they had sent several cease and desist letters to Glodich, but these went unanswered.

Nearly a month after the lawsuit was filed, Wembanyama voluntarily resolved the legal matter with a notice of dismissal, court documents show.

Court records show that Glodich did not file a declaration or motion in response to Wembanyama’s attempt to close the case, ending the possibility of a full trial.

Therefore, Wembanyama’s resignation letter effectively closes the case against Glodich.

Lawyers had initially said the unauthorized use of Wembanyama’s name, image and likeness damaged the star’s reputation. They also alleged that by selling items bearing the logo, Glodich was taking advantage of Wembanyama’s popularity and misleading customers.
