The P&H Supreme Court quashes the case against PUMA copy

Justice Karamjit Singhafter reviewing Article 13 of the Copyright Act, which describes the works subject to copyright, said:

“Under Section 13 of the 1957 Act, copyright could subsist in respect of the above classes of works. Thus, there could be no copyright in the manufacture and sale of garments. Thus, prima facie, the prosecution has failed to prove violation of the provisions of the 1957 Act, punishable under Sections 63 and 65 of the said Act.

The court therefore quashed the allegations of copyright infringement against the suspect.

The court also quashed a trademark infringement case against the man on grounds of failure to comply with the procedure prescribed in the Trademark Act.
