Unnao rape case: Kuldeep Sengar gets interim bail on medical grounds

The Delhi High Court on Thursday (December 5, 2024) granted a two-week period provisional bail on medical grounds to expel BJP leader Kuldeep Singh Sengar is serving a life sentence for raping a minor in Unnao of Uttar Pradesh from 2017.

A bench headed by Justice Prathiba M. Singh temporarily stayed the sentence. It directed that Sengar be admitted to AIIMS-Delhi for his medical evaluation and remain in the capital after discharge.

“Considering the history of the case and also the medical condition of the applicant, it is ordered that the applicant shall be released on anticipatory bail for two weeks and he shall seek admission at AIIMS Delhi for a comprehensive medical evaluation,” the court said. comprising Justice Amit Sharma, said.

The court sought a report from the AIIMS medical board and posted the matter for hearing on December 20.

Sengar is also serving a 10-year prison sentence in connection with the death of the Unnao rape victim’s father. His anticipatory bail plea in that case is still pending in another bench of the Supreme Court.

Sengar sought anticipatory bail as he was suffering from several ailments, such as cataract, which required urgent attention. The plea was opposed by both the victim’s lawyer and the CBI.

Case pending in the Supreme Court

Sengar’s appeal against the trial court’s verdict in the key Unnao rape case is pending in the Supreme Court.

He has requested that the court’s December 2019 judgment be set aside, which sentenced him to prison for the rest of his life.

The girl was kidnapped and raped by Sengar in 2017 when she was a minor.

On March 13, 2020, Sengar was sentenced to 10 years of rigorous imprisonment and a fine of Rs 10 lakh, in connection with the custodial death case of the rape victim’s father. The court had also awarded a 10-year jail term to Sengar’s brother Atul Singh Sengar and five others.

The rape victim’s father was arrested on Sengar’s behalf in a case under the Arms Act. He died in custody on April 9, 2018.

The rape case and other related cases were transferred to Delhi from a court in Uttar Pradesh on August 1, 2019, on the directions of the Supreme Court.
