ICE is taking into custody the Brazilian national accused of raping a woman in Plymouth

Federal immigration authorities have detained a Brazilian citizen living illegally in the U.S. after he allegedly raped a woman outside a Plymouth sports bar on Dec. 1, records show.

In a statementUS Immigration and Customs Enforcement said Boston’s Enforcement and Removal Operations Unit took 21-year-old Luan Lucas De Sousa Goncalves into custody on Dec. 2, a day after he allegedly raped the woman.

Police in Plymouth arrested Goncalves on Dec. 1 before extraditing him to federal authorities, officials said.

He entered the U.S. illegally in July and will remain in federal custody pending immigration proceedings, they said.

Patricia H. Hyde, ERO Boston’s acting field director, said immigration authorities filed a detainer’s warrant against Goncalves after his arrest, which credited local police. ICE has frequently criticized local law enforcement agencies for releasing undocumented immigrants without notifying them.

Goncalves pleaded not guilty in Plymouth District Court on Dec. 2 to charges of rape, sexual assault and assault, records show. His lawyer was not immediately available for comment.

According to a police report, the alleged attack happened around 1:20 a.m. outside the Main St. Sports Bar and Grill.

The woman told police she spoke with Goncalves at the bar, where they exchanged Snapchat profiles, and that they later began kissing consensually in a parking lot behind the establishment. But when she said she needed to go back to her friends inside, Goncalves allegedly forced himself on her without consent. She told him “no” several times, the report said.

When the woman spoke to police outside the bar, she was “hysterical” and “crying profusely, unable to catch her breath and (and) visibly shaken,” the report said.

Goncalves was arrested near the bar, police said. He waived his Miranda rights and spoke to police with the help of a Portuguese interpreter.

He told police that he and the woman had had a consensual sexual encounter, the report said.

Goncalves is due back in court on December 20. It was not immediately clear when he will appear before an immigration judge to begin possible deportation proceedings.
